The Supreme Court, has on Friday, declared as unlawful and unconstitutional, the Executive Order 10, EO10, issued by President Muhammadu Buhari on the funding of State Judiciary and Legislature, delivering judgment in favour of the 36 State Governors, Page 36 learnt.
In a split decision, majority of the Court’s 7-member Panel agreed that the President exceeded his constitutional powers in issuing the EO10.
The 6 out of the 7 members of the Panel of the Apex Court proceeded to void and set aside the EO10.
The majority decision also held that it is not the responsibility of the Federal Government to fund the capital and recurrent expenditures of the Superior Courts created for States, under Section 6 of the 1999 Constitution, as amended.
Also, all the 7 Justices agreed that the States are not entitled to be refunded all they have spent before now to maintain those courts.
The judgement was on the suit filed by the 36 States against the Federal Government, on the funding of the Judiciary, and the constitutionality of the EO10.
