Mike Ozekhome, the Senior Advocate of Nigeria, SAN, hired by the Governor of the Central Bank of Nigeria, CBN, Godwin Emefiele, to secure him a judgement that can allow him declare and run for the 2023 Presidency while still active in Office, has on Monday, told a Federal High Court Judge, in Abuja, that the CBN Governor is allowed by the 1999 Constitution, as amended, to run for Office, just like every other Civil Servant, while still active in Office, Page 36 learnt.
Recall, that some Lawyers and critics had argued that Emefiele is unfit to run for the 2023 Presidency, going by Section 84 (12) of the Electoral Act, that requires him to resign from Office, 30 days to the party primary elections.
The Section states that no political appointee at any level shall be a voting Delegate or be voted for at the Convention or Congress of any political party, for the purpose of the nomination of Candidates for any election.
However, Emefiele, through his Lawyer, Mike Ozekhome, argued that “he is more or less a Civil Servant, and by provision of the Constitution, he is expected to resign a month before the February 25, 2023, Presidential election” only.
He also contended that a Federal High Court in Umuahia, Abia State, had nullified Section 84 (12) of the Electoral Act.
